ICC allows Duterte to skip detention hearing — legal right or tactic?

MANILA, Philippines —The International Criminal Court has granted former Philippine President Rodrigo Duterte’s request to skip his upcoming detention hearing scheduled for February 27, 2026.

In a four-page ruling dated February 25, ICC Pre-Trial Chamber I approved Duterte’s written request submitted on February 23, in which he formally waived his right to be present at the annual hearing on his detention.

The Chamber, presided over by Judge Julia Antoanella Motoc, noted that Duterte, now 80 years old, voluntarily relinquished his right to attend the proceedings. “The Chamber notes Mr. Duterte’s waiver of his right to be present at the hearing,” the ruling stated.

This development follows earlier ICC decisions allowing Duterte to skip other hearings, including the confirmation of charges proceedings that began on February 23.

Duterte faces charges of crimes against humanity over his administration’s controversial war on drugs, which has drawn international scrutiny for alleged extrajudicial killings. The ICC continues to examine evidence and testimonies related to the case, while Duterte remains in detention pending trial.

The decision to allow Duterte’s absence underscores the ICC’s recognition of a defendant’s right to waive personal attendance, provided it is done in writing and with full acknowledgment of the implications.

The February 27 hearing will proceed without Duterte’s presence, as the Court reviews the conditions of his detention and considers submissions from both the prosecution and defense.

This ruling marks another significant step in the ongoing international legal proceedings against the former president, whose leadership remains a polarizing chapter in Philippine history.
