MANILA — Mananatili sa kustodiya ng Senado si Pacifico “Curlee” Discaya II matapos ibasura ng Pasay City Regional Trial Court Branch 498 ang kanyang petisyon para sa writ of habeas corpus, ayon sa desisyon na inilabas nitong Huwebes, Oktubre 16.

Sa desisyon ni Judge Melvin Cydrick Bughao, kinatigan ng korte ang kapangyarihan ng Senado na ikulong si Discaya matapos siyang i-cite in contempt ng Senate Blue Ribbon Committee dahil sa umano’y pagsisinungaling sa isang pagdinig noong Setyembre 18 kaugnay ng anomalya sa mga flood control projects.

“There was no sufficient evidence to prove Discaya’s argument of grave abuse of discretion for him to be placed in the custody of the Senate,” ayon sa ulat ng Super Radyo dzBB.

Tinukoy din ng korte na ang mga alegasyon ni Discaya laban sa Senado ay hindi sapat upang mapawalang-bisa ang contempt order. “The matter raised in the petition alleging grave abuse of discretion committed by respondents, not being an issue to prosper in the instant case, is deemed severed from the petition and dismissed without prejudice for being a misjoined cause of action,” ayon sa ruling.

Sa kanyang petisyon na inihain noong Oktubre 8, pinangalanan ni Discaya bilang respondents sina Senate President Vicente Sotto III, Senate President Pro Tempore Panfilo Lacson (bilang chairman ng Blue Ribbon Committee), at ang Senate Sergeant-at-Arms.

Si Discaya ay contractor na iniimbestigahan dahil sa umano’y pagkakasangkot sa mga ghost flood control projects. Siya ay nakakulong sa Senado mula pa noong kalagitnaan ng Setyembre.
